Terms & Conditions

1. Accepting these terms

These terms are an agreement between you and Cineptic (“Cineptic”, “we”, “us”). By creating an account or using Cineptic, you agree to these terms, our Privacy Policy and our Community Guidelines (our Acceptable Use Policy), which form part of these terms.

If you do not agree, do not use Cineptic. If you use Cineptic on behalf of a company or other organisation, you confirm you are authorised to accept these terms for it.

2. The service

Cineptic is an AI video studio. Through our website (the “Service”) you can generate videos with third-party AI models, in chats or in projects.

The models are built and run by other companies. We do not control how a model behaves, and which models we offer can change at any time.

Cineptic is an independent interface built on third-party AI models. We are not affiliated with, sponsored by or endorsed by the creators of those models, and model names are trademarks of their respective owners, used only to identify the model concerned.

3. Who can use Cineptic

  • You must be at least 13 years old, or older if your country sets a higher minimum age for using online services or consenting to data processing (for example, 16 in parts of the EU).
  • If you are under 18 (or the age of majority where you live), you need permission from a parent or legal guardian, and that adult accepts these terms on your behalf and is responsible for your use.
  • Payments by a minor must be made or approved by a parent or guardian.
  • You may not use Cineptic if you are barred from doing so under applicable law, or if we have previously banned you.

4. Your account

  • You must sign up for an account to become a user. You log in with your email and password, or with Google sign-in.
  • Give accurate information and do not impersonate anyone. Do not create an account in someone else’s name or pretend to be another person or organisation.
  • Anyone using your credentials is treated as you, or as someone you authorised. We may rely on that.
  • You are responsible for keeping your account and password safe. You are legally responsible for any damage caused by loss, theft or misuse of your account that results from your failure to take reasonable precautions.
  • Your account is personal. You may not lend, give away, rent, transfer, sell or share it. If you do, you bear the legal consequences.
  • Tell us promptly about any unauthorised use at support@cineptic.com. You can see your active devices in your profile, and changing your password signs out every session.

5. Payments and wallet balance

We have one plan: “Pay only for what you render.” There is no subscription and nothing renews automatically. You recharge your wallet and each render is charged from it.

  • Your wallet balance (or “credits”) is a virtual balance used only to access models on Cineptic. It has no cash value, is not a bank deposit or e-money, is not transferable and cannot be redeemed for money.
  • You see the price before you render. The amount shown is what is charged for that render.
  • A minimum recharge amount may apply.
  • Orders are processed by Creem as merchant of record. When you top up your wallet, the sale is made to you by Creem, operated by Armitage Labs OÜ (Tallinn, Estonia), acting as merchant of record and reseller. Creem handles payment, calculates, collects and remits sales tax or VAT, and issues your invoice or receipt.
  • Creem’s terms apply to your purchase. By completing checkout you agree to Creem’s Buyer Terms, and Creem processes your checkout data under Creem’s Privacy Notice.
  • You are charged in US dollars (USD). Prices shown in other currencies are estimates only and may change with exchange rates. Taxes may be added at checkout depending on your location.
  • We never receive or store your full card details. They are handled by Creem and its payment partners.

6. Refunds and chargebacks

Credited recharges are not refundable in cash. A render that is charged but produces no output is re-credited to your wallet balance. Both rules are set out below and apply subject only to rights that mandatory law gives you.

Credited balance

Once a recharge is credited to your wallet, it is not refundable, whether in cash or to your original payment method. Wallet balance cannot be exchanged or redeemed for cash, except as required by mandatory law or as stated in this section. Unused balance is not refunded when an account is closed; see Suspension and termination.

Failed renders

A failed render is a render for which you were charged and no output was delivered because of a failure, crash or error on our side or on the side of our providers. It does not include outputs that were delivered, or outputs you are dissatisfied with.

  • Automatic re-credit. For a failed render, the system automatically re-credits the amount charged to your wallet balance. The re-credit is to your wallet only, never in cash.
  • If the re-credit does not happen, email support@cineptic.com within 72 hours of the charge. State your account email, the date and time of the render, and any render or transaction reference shown in the app.
  • We will investigate and re-credit verified failures. To the extent permitted by law, claims not raised within 72 hours of the charge are not eligible.

Statutory refunds and Creem

Refund requests go to support@cineptic.com. Any refund we approve, or that mandatory law requires, is processed by Creem to your original payment method, and the matching balance is debited from your wallet. Creem may also issue a refund under its Buyer Terms.

Consumers in the EU and UK

By topping up you expressly request immediate supply of digital content and acknowledge that you lose your right of withdrawal once the balance is credited. This is without prejudice to your mandatory rights.

Chargebacks

You agree to contact us at support@cineptic.com before disputing a payment with your bank or card issuer, so that we can try to resolve it. We may suspend your account and recover the amount of an unwarranted chargeback, including by debiting your wallet balance.

7. Your content and who owns it

“Inputs” are what you give us: prompts, images, uploads and other material. “Outputs” are what the Service generates for you.

  • You own your inputs and your outputs, to the extent permitted by law and by the terms of the model provider that generated them.
  • You give Cineptic a limited, non-exclusive, worldwide, royalty-free licence to host, store, process, transmit and display your inputs and outputs solely to operate and provide the Service to you, to enforce these terms and to comply with the law.
  • We do not use your content to train AI models and we do not use it for marketing.
  • You confirm you have all the rights you need in your inputs, including permission from anyone who appears in them, and that using them does not break any law or anyone’s rights.
  • Outputs may not be unique. Other users may receive similar results. Whether AI output can be protected by copyright differs by country, and we make no promise that it can.

8. Acceptable use

Our Community Guidelines (our Acceptable Use Policy) are part of these terms. In short, you must not use Cineptic to:

  • Break the law or help anyone else break it.
  • Harm, deceive, harass or exploit people, or violate their privacy, likeness or intellectual property.
  • Create sexually explicit or sexually suggestive (NSFW) content, deepfakes, face swaps or other content listed as prohibited in the next section and in the guidelines.
  • Get around our safety systems, for example by jailbreaking filters or disguising prompts.
  • Overload, attack, probe or disrupt the Service, or access it in ways we did not intend.

9. Prohibited content and illegal use

Zero tolerance

You are solely and fully responsible for every prompt, input and output, and for any illegal prompt or action, including any attempt to create pornographic or adult content, deepfakes or other unlawful content. You alone bear all civil and criminal liability for it.

The following are strictly forbidden:

  • Any generation, solicitation, creation, acquisition, processing or distribution of child sexual abuse material (CSAM), grooming communications or sextortion content, whether the imagery depicts a real minor, an edited individual, or fully synthetic or AI-generated media.
  • Depicting any real person’s likeness in a sexual, intimate or pornographic way, regardless of consent, including revenge porn and deepfake pornography.
  • Depicting, generating or promoting sexual violence, human trafficking or non-consensual sexually explicit content.
  • Using another person’s name, likeness, face or voice without permission for defamation, scams, fraud, extortion or commercial deception, and identity theft or deceptive impersonation designed to trick the public, alter elections or manipulate civic participation.
  • Recruiting for, inciting or providing operational help to terrorist organisations or violent extremist groups.
  • Gratuitously violent media, extreme gore, torture or animal abuse.
  • Promoting or facilitating suicide or self-harm.
  • Targeted harassment, threats, slurs or content meant to dehumanise people based on race, ethnicity, national origin, religion, caste, sex, gender identity, sexual orientation, disability, age or serious disease.

Also prohibited

  • Sexually explicit and sexually suggestive (NSFW) content of any kind, including of fictional adults.
  • Deepfakes, face swaps and face manipulation of any real person, regardless of consent.
  • AI companion or romantic roleplay content, including characters designed to simulate a romantic or intimate relationship.

What happens if you break these rules

  • Prompts may be blocked or filtered automatically.
  • Attempts count as violations, including jailbreaking filters or disguising a prompt, even if no output is produced.
  • We may terminate your account immediately and permanently, without notice and without refund.
  • We preserve the relevant records and report CSAM to NCMEC and the relevant law enforcement authorities.
  • We cooperate fully with the authorities in any investigation.

10. Content moderation

  • Prompts and inputs are screened automatically before generation, including by a moderation service provided by our payment provider, and flagged requests may be blocked.
  • We may review content where needed to enforce these terms and the Community Guidelines, to investigate reports, or to comply with the law.
  • Automated tools can make mistakes. We give reasons for our enforcement decisions, and you can appeal as set out in the Community Guidelines.

11. AI output

  • AI output can be inaccurate, unexpected or offensive. It does not reflect our views.
  • Review every output before you use or publish it. You decide how it is used and you are responsible for that use.
  • Disclose that content is AI-generated or synthetic where the law requires it, and wherever not doing so could mislead people.
  • Do not remove or hide watermarks, AI labels or provenance data added to outputs.

12. Third-party models and services

The Service relies on third-party AI model providers, infrastructure, and Creem as merchant of record. Your use of their models may also be subject to their terms and usage policies, which you agree to follow. We are not responsible for third-party services, their availability or their output, beyond what the law requires.

13. Our intellectual property

Cineptic’s software, design, name, logo and content belong to us or our licensors. These terms give you no right to them beyond using the Service. You may not copy, resell, reverse engineer, decompile or scrape the Service, or use our brand without written permission, except where the law expressly allows it.

14. Copyright and IP complaints

To report infringing material, email support@cineptic.com with the subject “Copyright” and include:

  • The work you claim is infringed.
  • The location (URL) of the material.
  • Your contact details.
  • A good-faith statement that the use is not authorised.
  • A statement that the notice is accurate and that you are the owner or authorised to act for the owner.
  • Your physical or electronic signature.

We may remove or disable the material and notify the user, who may send a counter-notice with an explanation. We terminate repeat infringers in appropriate circumstances. Knowingly false notices may create liability.

15. Suspension and termination

  • We may suspend or terminate your account if you break these terms or the Community Guidelines, if the law requires it, or to protect users, the public or the Service.
  • Balance tied to a violation is not refunded.
  • You can delete your account at any time from your profile or by contacting support.
  • When your account is deleted, any remaining balance is forfeited, unless the law requires otherwise.
  • Sections that by their nature should survive termination (such as ownership, liability, indemnity and governing law) continue to apply.

16. Changes to the service and prices

We may add, change or remove features, models and prices at any time. A price change never affects a render you have already paid for. Where a change materially reduces what you can do, we will try to give you reasonable notice.

17. Disclaimer of warranties

The Service is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement and uninterrupted or error-free operation. We do not guarantee any particular output, quality or availability.

18. Limitation of liability

To the extent the law allows, Cineptic is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill.

Our total liability for any claim is limited to the amount you paid Cineptic in the 12 months before the claim arose.

Nothing in these terms limits liability that cannot be limited by law, such as for fraud, or for death or personal injury caused by negligence.

19. Indemnification

You will defend and compensate Cineptic and its team against claims, losses and costs (including reasonable legal fees) arising from your inputs, your outputs, your use of the Service, or your breach of these terms or the law.

20. Governing law and disputes

Talk to us first. Before starting any formal claim, email support@cineptic.com and give us 30 days to try to resolve it informally.

These terms are governed by the laws of Bangladesh, and the courts of Dhaka have exclusive jurisdiction. This does not take away the mandatory consumer-protection rights you have under the laws of the country where you live.

21. Changes to these terms

We may update these terms. We will tell you about material changes by email or in the app before they take effect, and update the date at the top. Continuing to use Cineptic after that means you accept the new terms. If you do not agree, stop using the Service and delete your account.

22. General

  • Entire agreement: these terms, the Privacy Policy and the Community Guidelines are the whole agreement between you and us about the Service.
  • Severability: if a part is found unenforceable, the rest stays in effect.
  • No waiver: if we do not enforce a right straight away, we have not given it up.
  • Sanctions and export compliance: you may not use the Service if you are subject to applicable sanctions or export restrictions, or from a sanctioned jurisdiction.
  • Force majeure: we are not liable for delay or failure caused by events beyond our reasonable control, including outages of third-party providers.
  • Notices: we may give notice by email to your account address or in the app. You may give notice to support@cineptic.com.
  • Relationship of the parties: nothing here makes you our partner, agent, employee or joint venturer.
  • Consumer rights: nothing in these terms limits the mandatory rights you have as a consumer under the law of the country where you live.
  • Assignment: you may not transfer your rights under these terms. We may transfer ours, for example in a merger or sale of the business.
